Advice re: cancelled event

I've just found out that the festival I was due to go to in two weeks time has been cancelled. Instead of a refund, the organisers are sending out free tickets for next year. I don't want to go next year, I want my money back! I really can't afford to lose £100. ?

Does anyone have any idea what the legal position is here? The tickets state that no refunds can be given, but surely that doesn't apply if the event is cancelled? I have no idea where to look for legislation/advice, can anyone point me in the right direction?

    I am suprised I would have thought they'd have looked into it more before insisting you have tickets for next year instead of a refund.

    Actually its very vague about outdoor events, but did you pay by CC you may be able to claim through them

    Thank you, I did look at consumer direct but am still not clear on my rights.

    No I paid on my debit card, so no joy there. I really want to cry, £100 is a lot of money to us at the moment.

    You are absolutely entitled to a refund. Their clause about "no refunds" falls foul of the Unfair Contract Terms Act (section 3, I think).

    Practically, the issue may be that they are about to go bust and can't afford to refund people- I can't think of any other reason that they would attempt something so clearly unfair.

    If you want to get the right words/act to fight them on speak to these people. They are excellent.

    Agree 100%. Their advice got me and H out of contract with the gym when we relocated, saving us almost £800. Give them a call and they'll tell you what to do. They also give you a reference number in case you need to call back for further advice and will inform Trading Standards if necessary.

    KN, they are already trumpeting about putting the festival on in 2010 so presumably not about to go bust. I think they're probably seeing what they can get away with.
