Advice Re DIY divorce!

irishsorone, 12 January, 2010 at 16:31 Posted on Off Topic Posts 0 9

I really need a divorce as its doing my head in still being married to a waste of space! My other half said that he'd sort and we'd have court date for January but now hes telling me that it could take a year as hes applying for legal aid!

Theres no disputes, we've been separated for over 2 years and we agree on everything for money and child so all we need is the actual divorce, no other arrangements to make and splitting things! I got papers before from the net to do a DIY divorce but couldnt work them out! Is there a book that takes you through it step by step?

I just want a divorce! any advice welcomed

thanks

I just had my divorce finished in November. I too had everything agreed and we split it down the middle. I ended up going to see a solicitor. Was easier imo than doing it online.

I'm sure if you googled there could be something that could explain step by step.

Neither of us can afford a solicitor, my house alone takes 70% of my wages and hes just coming of the dole!

Hiya, not sure its any help but 3 years ago i did mine myself. Downloaded the forms from the courts website (they also have an explanatory section on there) filled them in and it cost me £40 in total! Took less than 4 months from start to finish so well worth a go i think.

Good luck Smiley smile nothing worse than being stuck in a rut!

I agree with Andrea that it can be easy.

My H got divorced in a few months (after a 2 year separation and with consent) without any solicitors or court dates. The court in England sent out the papers to us in Scotland, filled them in and then they did all the necessary correspondence. It was potentially harder for him because 2 kids were involved and they live in England with their mum and he lives in Scotland but as long as the papers are correct there isn't any need for it to be complicated. It cost more than £40 though, I think nearer to £250, but maybe every case is different.

Don't do it online or through a DIY service as the courts can give you all the paperwork and information you need.

It is a totally different case if you haven't been separated for 2 years with consent or 5 years without though.

This website might be useful https://www.gov.uk/divorce/overview certainly was to us.

Legal Aid doesn't take a year to do! I was a paralegal and it is usually agreed in a matter of weeks. There shouldn't be any need to have legal aid if you can do it the same way my H did and don't involve any solicitors.

    Good luck

Thank you both! My ex is still adamant that it takes a year for legal aid, but hes a dick!

I got the forms before and they just all seemed so complicated, but ill give it a go, and im not useless with forms either, might be our system over here!

Ours is with 2 years separation and with consent, we have a child but there are no disputes over his care!

I got divorced via an online place, we just had to register it with the local courts and it was fine.

It's not too expensive and they can give you help if you need it, but TBH, I just made sure I read everything carefully and double checked before signing.

I just went to the local court office, they gave me the forms needed and a set of simple to understand explanatory booklets and I filled all the forms in myself. All very simple and very little cost. If the petitioner (the one applying for the divorce) is on benefits, you just send in a copy of your benefit advice and the charge is waived or reduced, but it explains it all in the booklets. As long as your OH returns the forms promptly it will be final in 3-6 months. If he has no income it might be better for him to divorce you. I filled the forms in for my OH and got him to sign them, then I posted them, so I knew they had been sent!

I bought a book called "do it yourself divorce" and it took about eight months and was not too expensive. The book kept the solicitor costs out and the paperwork went via yourself and the courts, was a reasonable cost and fast.

Last time I did it on line. It took six months but should have took four months. It is a very reasonable price and very easy.
