Any HR people about? Redundancy / Maternity Pay question

RachelHS, 29 January, 2009 at 14:41 Posted on Off Topic Posts 0 1

I have taken voluntary redundancy and my last day at work is tomorrow. My last day as an employee of this company is Saturday. I will also be 28 weeks pregnant on my final day, and reached the 'qualifying week' for maternity entitlement two weeks ago. It has been confirmed in an FAQ on an intranet site that individuals who had reached the qualifying week before the last day of employment would be entitled to full maternity pay. I sent all my forms back at the correct time, so have done everything I should have done to ensure that my paperwork is in order, both for redundancy and for maternity pay.

I have had notification of my redundancy pay, and am happy that that's all in order. I haven't yet had confirmation of the maternity pay I'm entitled to, and am getting a little concerned...

When I sent the signed letter confirming that I was taking VR, I added a statement to say that I understood I was entitled to maternity pay according to employment legislation and company policy, as I had reached the qualifying week. I have also saved a copy of that letter, along with the FAQ I mentioned earlier.

In my company, I cannot contact HR directly. I have to contact my manager, who then contacts HR on my behalf. I think my manager is getting fed up of me hassling her, as I've e-mailed or texted her at least 3 times a week for the last 6 weeks! HR are not responding to my manager's queries on my behalf, and payroll is apparently aware of the situation.

Is there anything else I should be doing? My husband is making noises about taking legal advice, but I think it's a bit soon for that.

    Hello,

I think you've done everything you can. Shame on your manager for not understanding your concern though.

It's probably just HR being crap and not getting their house in order. Are there many redundancies happening at the same time as perhaps they're concentrating on processing those first and will then move on to other issues (not that I'm making excuses for them). When are you expecting your first payment of SMP? It should be paid for you as per your normaly payday so if you are paid monthly and get paid tomorrow it will be paid the following month. Do you know if they are paying it in a lump sum to you?

I would keep on the case but don't feel you really need to start jumping up and down yet maybe if you still haven't heard anything as your subsequent payday gets nearer.

I hope they are on the case but if not, you're leaving so who cares if your manager is getting fed up with you nagging ? - they're meant to sort out staff issues, surely?!

    Good luck!

    Thanks for the reply.

Yes, there are lots of redundancies happening. I was included in the third round of VR, and the next round of redundancies is involuntary - so I imagine they're pretty busy.

I think HR has probably been cut back by redundancy as well. My company was taken over by another company about 6 months ago, and have been mentioned in the press because of these redundancies. Apparently they didn't do something correctly and the union was complaining about it... Unfortunately I'm not a union member so they can't help me.

I wasn't due to start maternity leave until April, so my first payment for SMP wouldn't be until then - however according to the FAQ I'm supposed to recieve all maternity pay in a lump sum after I leave employment.
