Banks & Repossion Help Please

If the bank claims a property back, what usually happens? We live in a tied cottage and the bloke who owns it hasn't been paying th mortgage, he's expected in court this week but is convieniently on holiday and not in the country! What will happen to us? What will happen at the court case, even though he won't be there? We are looking for somewhere to live and have had some advice from the C.A.B

    It's difficult to say without knowing how far into the process he is. If he is due in court I would think perhaps it is to discuss whether a possession order will be given to the bank. If he is not there to defend this then chances are they will go ahead and decide on a date for possession- its normally around 6 weeks.

    I hope you find somewhere to live soon- what will happen to MrT's job?

    We were renting a place and the landlord stopped paying the mortgage (we didn't know he had) - it went to court and he didn't show and the bank was given a posession order. We got a letter saying that they had a posession order and that there would be an eviction notice to follow. We were unlucky, our eviction order came immediately after the posession order (next day) and we were given 2 1/2 weeks to move out (this varies from case to case).

    I'm not 100% sure how long the court case etc and other stuff went on as we were completely oblivious to what was happening. Nobody except the owner normally gets anything till the posession order comes. Make sure you look out for mail that says 'to the occupier' - thats how our posession and eviction orders came.

    Thanks for the bounce and the advice, Mr T has already lost his job but he has still been doing the jobs as it's mainly animals involved and his boss is useless lol! Looks like we will have to up the pace into finding somewhere then as we were given 6 months from the C.A.B! It's tricky trying to find somewhere nearby as we have lots of house and kennel dogs Smiley sad Thanks anna belle i'll keep an eye on the post. xx
