Contact/residency court orders

Can someone clarify something for me please?

If there is a contact/residency order in place, and the absent parent breaks the order (that he instigated), by not seeing children for months at a time, and then calling to say he's picking up children out of the blue, and at other times calling the day before he's 'supposed' to pick them up and cancelling, is that court order then 'null and void'? Or is it (as I presume) still valid?

    Hiya,

    I think if you can prove that he has not stuck to the order & he then took you back to court, the court would look very dimly on him. The courts are only interested in the welfare of the children & him not turning up or cancelling is not good for them.

    Do you think he would bother taking you back to court if he's not too bothered about sticking to the order?

    I think he would take me back to court. Mainly to prove a point, and that he still has 'control'.

    Unfortunately I don't think it would mean that it's automatically null and void. You would need to take him back to court to do that. Are you in a position to do that?

    It sounds much like the situation that my friend is in. Her ex keeps breaking a contact order that he instigated and then calls up the day before he wants to see his son when it's not convenient for my friend. He always threatens to take her back to court if she says no as it makes him feel all powerful.
