Help from HIBs please

Hi

Sorry to be a bother - I remember one HIB giving me a link to a program which checks if my photos are being used by other websites - I thought I had saved it as a favourite but can't now find it.

Can anyone let me know what it was. I found one company previously using my picture and they still haven't removed it, but want to check some other pictures.

    Hi - I think it's Copyscape you're after. You can ask the Trading Standards to ask the offender to remove it. They do take action (they did for me) and coming from them, they tend to take more notice as they can be fined quite heavily.

    The other method is send them a letter of removal giving them 14 days to remove the images or they will be charged for the useage of the images.

    If you need advice I would recommend contacting the british institute of professional photography as they have a legal team that may offer advice.

    I get a lot of plagiarism problems. Copyscape is great, well worth it for seeking out copied text. When you find an instance of pagiarism, you need to send them a 'cease and desist' (e-mail is fine) letter before you do anything else. It always does the trick and saves the hassle and cost of getting a solictor involved.

    Here's a copy of mine:

    NAME

    It has come to my attention that you have made an unauthorised use of my copyrighted work entitled [NAME OF YOUR WORK] (the "Work") in the preparation of a work derived therefrom. I have reserved all rights in the Work, first published in [DATE YOUR WORK WAS PUBLISHED], and have registered copyright therein.

    Your work entitled [NAME OF THEIR WORK] is essentially identical to the Work and clearly used the Work as its basis.

    As you neither asked for nor received permission to use the Work as the basis for [THEIR WORK] nor to make or distribute copies, including electronic copies, of same, I believe you have wilfully infringed my rights and could be liable for statutory damages.

    I demand that you immediately cease the use and distribution of all infringing works derived from the Work, and all copies, including electronic copies, of same, that you deliver to me, if applicable, all unused, undistributed copies of same, or destroy such copies immediately and that you desist from this or any other infringement of my rights in the future. If I have not received an affirmative response from you by [INSERT DATE IN 14 DAYS TIME] indicating that you have fully complied with these requirements, I shall take further action against you.
