Help please- Resignation - leaving- holiday pay -advice

My husband has worked for the company for almost 7 years and is leaving on friday as he has a new job, his boss is being a bit funny with him to say the least anyway, he was called in the office today and bossman asked him if he could clear anyoutstanding work by friday (this is a bit strange as he would anyway) then bossman asked how many holidays have you taken this year, husband replied 10 days, then bossman said oh good then we dont owe you a penny then.

now husband get weekly paid and did a week in hand so I have worked it out like this

last weeks pay plus this weeks pay ( week in hand)

20 days holiday minus 10 days taken comes to 10 days holiday (or 2 weeks pay)

so in total

he is owed 4 weeks pay

am i right or dont you get holiday pay when you leave a job.

    He wont get his full holiday entitlement as he is leaving the job.

    For example, i get 24 days a year, or 2 days a month. My holidays run April to April. If i left now i would have accrued 12 or 13 days, not the full 24.

    Holidays will be pro-rated. So, to work out how many holiday he would have been entitled to you need to do:

    Number of days (20) x Number of weeks worked this holiday year / 52

    It depends when the holiday year runs from/to as it will be pro rated accordingly. Also since October 2007 (I think) the minimum holiday entitlement is 4.8 weeks (24 days for a full time/5 day a week worker)

    If you have untaken holiday entitlement then yes you should get paid for that when you leave.

    But to work out what it is you need to know:

    How many days (including weekends) he'll have worked in the current holiday year

    How many days holiday (including bank holidays) he has taken

    How many days holiday (including bank holidays) he is entitled to in the whole year

    When the holiday year starts and ends.

    If he is leaving part way through a leave year then obviously he won't have a full year's entitlement to take, as others have said it will be pro rata for the part of the year he has worked.
