HR Experts or Company Phone Users (Sens)

Hope this is not a ramble, but on iphone writing this.

Person has a company blackberry

Never an issue with it being used outside the office & had the mobile for 18mths +

Person has left the Company (resigned), but is currently on 1 months notice at home.

Company raise a disciplinary issue (yesterday) over what they call is excessive personel use & state 1 private number that was phoned/text (35 times) during the period 20th Jan 09 - 31st March 09

This number is the wife of the person & she was in hospital on & off due to threatened miscarriage, which happened on 27th March.

The only time this person had off this year was the day his wife miscarried & calls were not made whilst inside the office, as there is a no mobile policy in place.

Are MrJMP & I on the correct understanding that it's viewed acceptable by the company if they have never raised a concern over previous use? I can't think for the life of me what it's classed as .

Section 2.3.1 of the IT & Data Protection Policy states that ‘Access to XXXXXXX resources is a privilege granted to its employees, which carries with it the responsibility to use them for work related activities, exercising common sense and civility’.

    I really don't know the answer but what would the company achieve by raising this now when the person is leaving anyway?

    Very odd. A first offence (and especially given the circumstances) should be dealt with by a warning anyway. Sounds vindictive to me as I can't see what is to be achieved by running through the process. I have access to my staff bills but I'd expect one phone call home each day under normal circumstances.

    Thanks both - We can't see what there is to gain except trying to ruin a perfectly good persons employment history - the guy feels so sick.

    BGB - Vindictive is what comes to mind.

    I'd bear in mind that it would be unwise of them to reflect the process in any reference as it could be seen as disproportionate.

    It's incredibly petty of them IMO but if it would make it all go away, could he offer to pay for what they consider the excessive amount? After all it can't be much can it.

    That sounds very spiteful to me - we have a £5 month allowance for personal calls and texts , when we get our mobile bill we highlight any personal calls and pay back anything over the £5 through our expense accounts.

    I know some people really take the piss with company mobiles but it doesn't sound like the case here.

    Is there a chance that the company fears this individual is thinking of bringing a claim of constructive dismissal? To me it sounds like they might be trying to set up a defence to any proceedings (by arguing that if the individual had not resigned he might have been dismissed shortly thereafter in any event). Otherwise bringing a disciplinary against someone who has resigned is utterly bizarre.
