i think i need legal advice re. the car issue

As some may remember, this happened at the weekend

BMW have looked at it and said that its the turbo that has disintegrated, therefore nothing to do with the oil service they did for me the day before it happened (surprise, surprise)

They now want £440 off me to take the engine apart to see what has happened in there, as they are saying it may not be as bad as we think. However, the crank wont turn and even i know that means the engine is shot. So, they are going to charge me £440 to tell me i need a new engine, which i already know! WWYD?

They have said a new turbo will be approx £1500 fitted and a new engine around £8000! They have said that once they have assessed the damage they will write to BMW UK and try to get a 'good will' payment from them, towards the cost as this shouldnt have happened to a 4 year old car with full BMW service history. I have spoken to an old friend who used to work for them and she said the only time they offered 'good will' was if they had messed up. So i am thinking that it is something to do with the oil service they did. They said to me that they would never try to cover this up, as if it ever got out, it would put them in a bad light, but surely admitting they had sent a car out onto the road in a damaged state would do the same??

Help, i dont know what to do, should i argue with them, or just pay up and shut up?

    Tough one. I definitely wouldn't just pay up but I'm not sure exactly what you should do. It sounds like you need a second opinion from someone independent to make sure BMW don't fob you off. Could someone like the AA help?

    What has the service manager said?

    I would expect within 24hrs, not having to check oil level if this had been done by a main dealer - The same as brakes failling 24hrs after an MOT.

    Hi Claires

    I've just spoken to my husband about this again, he said something doesn't add up. But the crank being gone means the engine is fecked.

    He suggests either fighting them, or getting an independent garage to look at it and see if they can locate a second hand engine for you. If you let me know the spec of the car he'll give a few people a call and see how much he could maybe get an engine for, he's thinking £800 roughly. £8k for a new engine fitted is bull and something you'd expect from a main dealer.

    Under either your household insurance or car insurance do you have included a legal helpline? In my house insurance we have this and you can use it for legal advice on anything, as far as I know. I think this is what you need now (legal advice, not a change in insurance)

    HL - i tried the legal line, they said get a second opinion and that was it. i think i am going to

    KB3 - its a 320D 2 litre engine code is M47tu is there anything else he needs? Oh and the £8k was just for the engine, labour was on top of that?

    KB3 - thank your H for his help, its a bit of a nightmare being without a car as i need one for work, i am having to use my Mums old banger at the moment?

    Right he said give him til tomorrow and he'll see what he can do. Can youlet me know the year of the car (04/54?) and he's assuming is a 3 series.

    Sorry my mistake he said year of car so is an 04, 2004?

    My 55 plate is a 2006 car, it's very odd.

    Claires, are you around? My husband may have located an engine for you! It's from a 1 series but apparently they run the same as the 3 series, but he'd need the chasis number or your full reg to make sure it's compatible. Apparently they run the same but vary very very slightly. Anyway, PM me and I'll send you a message now to.
