I was right to be worried - Photographer - UPDATE in op

Hi

A wee while back I posted how I was concerned that I had not heard anything from my photgrapher and that his last post on blog had stated he was opening up shop in South Africa.

I was trying to contact him as we were looking to change the package we had booked with him as we paid a deposit two summers ago but now scaling down the wedding slightly. Anyway my Mum emailed him asking him to contact her urgently, he told her he is moving perm to South Africa but would still take pics at my wedding. He offered her a new price on the phone for digital only package with agreement we will order album after wedding when we have more money. He now has emailed her saying logistically he can't afford to fly back from South Africa and wants to pass us on to another TOG who he has provided details of - can he do this? Where do you think I stand on getting my deposit back? To be fair other TOG looks great anyway but just feel like Im getting little choice??

Well finally met new photographer and he is fab - he has taken beautiful pictures of my venue previous so very happy - however he was the guy recommended by original photographer but he has not given him any of our deposit is this normal? New photographer not asking for deposit but I think he should get deposit from old photographer?? Any thoughts

    That is so unprofessional! You dont HAVE to go with anyone you didnt book with so unless you like the other tog I'd be asking for my money back.

    Hope you sort something out soon.

    It depends on what's on he's contract

    as our photographer , has said that if anythig were to go wrong on our wedding day ie he was ill etc , he would send one of he's other friends who also is a prof' photographer

    we've seen his work so know we are sae - and he explined all this to us , before we signed

    so just double check your contract

    I would say but depends on what his contract states that you are entitled to a refund of your deposit because he is the one who is not fullfilling his part due to the fact that he has moved to South Africa and can't do your wedding due to finances to fly back. He's not ill, he's moved away and in doing so he should as a matter of courtesy and professionalism return the deposit to you.

    Either a refund or he as he has said gives the booking to one of his friends minus your deposit - he and friend can then sort the matter of deposit out between them! You don't then pay 2 deposits the other tog just deducts this of his price - this wouldn't work though if he wasn't a friend!

    I would agree with this. You know nothing about his suggested replacement nor have met. You have no idea apart from some images seen what what the service level is like. You also have no contract with this new tog......or will they work to the original togs contract.......too many questions.

    Go to consumer direct for advice, they're on the internet and you can get the phone numbers you need there. Technically you paid a deposit, so he has to offer that back to you.

    Thanks guys for the advice - still not sorted this out yet, I have spoken to the gy he has recommended and he seems nice hopefully going to meet him soon. Not sure what will happen deposit wise if we don't go withthis guy but he is def breaking contractSmiley sad Just don't have the money to pay out for another deposit just nowSmiley sad But anyway Ill keep you updatedSmiley smile xx

    He needs to refund YOU! He's broken your contract! And ok if he'd transferred the deposit to this other guy then fine though not good practice!!! Ask him for a refund

    That's bad news, but at least he's been honest and told you he is in South africa.

    Contract or not, you will have little chance of taking him to court if he is abroad.

    You should get your deposit back, or he should pass it onto the new photographer, but it depends on if he has any morals or not.

    As long as you are happy with the new photographers work then don't worry too much, just hope that he turns out to be reliable.

    Yeh new guy seems great as you say its definately going to be hard to chase him, I have spoken to Citizens Advice and we have contacted him and he has replied that he will consider his options!!! lol

    Anyway very happy with my new TOGSmiley smile xx
