Legal property / rent type question

Im just about to sign on the dotted line to transfer the house that my gran left when she died from me to me and my mother as tenants on common. Its a complicated story but the gist of it is my great grandads will held the house my gran lived in in trust, my grans will left eveything to me, great grandads will overrides grans will. Decision from High Court made to split house tween me and my mother 50/50. House in meantime registered solely in my name so now 4 1/2 years after my grans death the trust and estate are finally wound up and its down to me to sign over half of the house to my mother.

Now, my mother and step father have been living in the house all this time rent free. Its in my name and Ive got nothing whatsoever from it. Theyve not done any maintenance to it and its in need of repair. We want to sell the house once everything is sorted out. Am I entitled to back rent? If so can this be reflected in the proportions of the tenants in common once its signed over, so for example the split is more 60/40 in my favour?

As I said its complicated, and I think Imight need to seek legal advice, but wondered if any legal eagles on here could help.

    In theory one co-owner can have to account to another for use and occupation but no-one here is going to be able to give you proper advice as the terms of the High Court orders etc.. need to be taken into account. You should take proper advice about this. Good luck.
