My dress :'( UPDATE +ve I think...

jem179, 29 January, 2010 at 10:54 Posted on Planning 0 13

Before Christmas I spoke to the designer who was making my wedding dress as the shop I ordered it from were having a few problems (supposed to be moving and then not moving...). He said he hadn't been paid even though the shop had told me they had to pay up front but that was his problem at the time and not to worry about it. Meantime my dress was due by the end of January.

I hadn't heard any more from either the shop or the designer. Up until last week the website for the shop still said we are moving. This week it changed to trading update statement due here shortly. I was getting a bit worried so I called the designer this morning. He wasn't there so I spoke to his assistant. Turns out the shop has told them that they have refunded everyone who has paid a deposit except they havent. I havent had a penny back. As the designer hasn't been paid they need £290 (the cost price for making it) to release it. THe dress had already been over my budget at £660 and I only had £120 left to pay. The dress is already in and is sat with the designer pending payment.

The assistant has said he will contact the main designer and see what (if anything) could be done but he wasn't very hopeful as they hadn't actually had a penny from the shop for any dress since September last year so they are already way out of pocket on delivered dresses.

OH is ringing his bank now (we used his debit card for the 2 deposits) to see if there is anything they can do...but it was 4 months ago that I ordered the dress and we paid with debit not credit card. I know it's onlt a couple of hundred pounds but we are maxing out the credit cards as it is to pay for everything (all 0% so we weren't too worried) and now I might have to magic the money from thin air! I just don't know what to do...

I would get any proof of payment you have - receipts, bank statements etc and contact someone along the lines of trading standards to see what your best course of action is.

Sorry to hear all this though, just what you don't need / want.

That's awful! Is the shop not actually open now then? Have you been able to speak to anyone at the shop at all?

The designer hasn't been paid anything yet? Is the £290 they're after the total cost of the dress?

Don't know how these things work - Lorna sounds like she's the best offer advice at the mo - Is there anyway you can pay the £290 to get your dress and then sort out the claiming process later?

Just been on the phone to them, they have been so good.

Spoke to consumer direct and they have given me some great advice, need to write her a letter and give her two weeks to refund my deposits or pay the designer what she owes him so will get onto that later. And hopefully that will get it sorted. Managed to get her home address and phone number off the internet so at least I have somewhere to send it!

GB The shop came to the end of it's lease in December so it closed before Christmas...and no the designer hasn't been paid anything. the £290 is the cost price to them for getting it made and shipped to this country. They haven't been paid anything at all since September even for dresses that they sent on to the shop so are well out of pocket and issuing proceedings themselves.

BUT GOOD NEWS!! They have been absolutely fantastic. The designer has just rung me and agreed to split the cost with me. As he said it's neither of our faults but he has asked that if I do manage to get anything back from her that I just send him the extra which imo is fair enough. I have never dealt with such lovely people. I have paid the difference and they are going to ship it out to me... so now we're both out of pocket but at least I will have my dress! (although I'm trying not to get too excited until it's actually here...)

Well, I'm pleased you're getting your dress finally!

And that was very good of them to trust you to split anything you get back with them! I just hope you do manage to get something. Will keep my fingers crossed for you

Jem thats great news!! and im glad consumer direct were able to help you, as for my dress it HAS now been delivered and i have my fitting tomorrow at 3pm (yes yes yes will get lots of pics!) but there is still the issue of the extra £348 as victoria had to pay that to the supplier even though she wasnt liable (she is trading as a separate business) iam still in the process of getting £208.12 back from the visa chargeback scheme they have had to send me out a new declaration as the one they recieved back by fax wasn't legible! so at worst it seems i will be around £140 out of pocket at best if (and its a very big if) the adminsitrators accept my claim i should hopefuly get the rest back.
