OH changing name and legalities

firefairy, 22 May, 2012 at 20:12 Posted on Planning 0 6

Hi ladies,

I imagine I will have to ask the RO this anyway but was just wondering if anyone has done/knows about how this works.

My OH is planning on taking my name and I know we have to do that by deed as there's no way for a man to automatically change his name legally when marrying (how sexist?! lol)

His mum came up with the idea that he should change it before the RO ceremony then we can sign the paperwork with the same name. (which i thought was cute)

However, would this affect the giving notice? I.e would my OH have to change his name by deed before we give notice as otherwise he will be giving notice with a different surname to the one using when we get married?

Its all very confusing!

I'm not changing my name as my Dad only had my sister and myself so our name will die out and when I was about 5 i promised to keep mine! My OH doesn't mind me keeping mine, and offered to take mine as hes not particularly attached to his (divorced parents etc). We didn't want to double barrell as I already have 2 middle names and they don't fit on forms as it is! I think it was actually his mum's idea for him to take my name when it was mentioned I wasn't taking his!

I'm assuming you can't change your name after giving notice as all the details need to be 'correct', but might be worth ringing the RO to check.

Everything you need to know is here: http://www.ukdps.co.uk/Introduction.html

It looks like you can change name before the wedding and they'll alter the notice, or leave it all until afterwards.

My h2b has changed his so he is taking my name as well as his own. In order to give notice in his new name he must (as I understand it) have his birth certificate, deed poll certificate, pass port or other photographic I.d in his new name and utility bill in his new name.

    Hope this helps!
