O/T - Sorry but does anyone know about e bay at all? WWYD!

I bought a BIN item (a wedding bolero) from a UK based business seller on 19th December, the seller emailed me to say they would post it after Christmas and so I didn't receive it until Saturday 2nd January. The item was not what I expected, rubbish quality, didn't fit (despite me sending measurements), sleeves shorter than the picture, badly made. Not to mention it was posted screwed up in the bottom of a carrier bag (yes a bloody carrier bag - not what I expected for my wedding day bolero jacket!).

I opened a 'return items case' which the seller promptly shut. I emailed to find out why and they replied they don't accept returns only exchanges (which was no good to me as the wedding was by now days away, and the item was crap quality anyway). As a business seller and a BIN item I believed they should by LAW accept the item back and refund me so after a few emails back and forth they very grudgingly agreed to refund me, on the condition they received the item back within 7 days (again I belive they are breaking the law here putting stipulations like this on it!!). Anyhow I posted it back and it turns out they aren't in UK at all but they are in Spain! I sent parcel signed for on 2nd Jan and I still haven't received a refund. When I've tracked the item it says the parcel has been passed onto Spanish postal people for delivery. I'm not sure if I would be notified when they received it or not with them being overseas?

Anyhow, my question is I am going away tomorrow (finallly booked a honeymoon!!!) and I won't have access to the internet while I'm away to see if they have refunded me and I am getting nervous that they won't. I don't want to jump the gun but surely they'd have got it by now? I feel that time is running out I believe for filing anything official with Paypal/Ebay who I believe only allow 30 days from buying the item (which will be 19th Jan) and I won't be back till after this. In other words if I do nothing, go on honeymoon and they DON'T refunded me, I have no official routes open to me to get my money back. Should I open a resolution dispute now on ebay? I've looked on google and there is something else called a SNAD via Paypal but not sure what this is or how I raise one. I don't want to contact the seller again, they are obviously scam merchants.

What would you do in my shoes? ?

    Hmmm, Did you buy it via PAYPAL? I would take it up with them and open a case telling them that they are refusing a refund although the item is very poor quality...

    (You're not allowed to sell something that looks completly different to how it is shown on the picture, IE you order a pink top with sleeves you should get a Red top without sleeves, even if it is bad quality etc...)

    The other thing is give them an AWFUL ebay feedback, hopefully that should stop them in their tracks soon!!

    I don't know much about these things but I would open a dispute thing now with ebay and get the ball rolling. Even if yu think it's a bit early, it's better to cover your bases as you won't be around when the 30 days are up. Can't be more help than that...sorry....

    Hi HB, firstly yay you''ve booked something! Did you manage to get something abroad?

    Ebay wise, I'll check, but I thought you got 45 days from purchase to open the dispute, but if your worried you can just open it before you go away to be on the safe side. All that happens, if they refund you you can just close the dispute.

    They do sound like a bunch of cowboys!

    (Oh and how did it go last monday? I never 'saw' you before the wedding, are you keeping it secret (I guess pink!)

    Thanks Steelgoddess. Yes it was purchased via Paypal. How would I open a PP case exactly? Log into my PP account?

    The thing is they did agree to give me a refund but the fact I haven't got it yet is making me nervous!!

    The seller said the sleeves are the same length as their picture. I thought as a business seller to comply to the distance selling regulations buyers had the right to change their mind if they wanted for any reason?

    Don't want to give feedback until I have my money!

    Hi MDD!!! Ah is it 45 days? Not sure if to open an ebay resolution or a paypal dispute (not sure how to do this though). Yes booked a week in Egypt! Yiiipppeeee! Got to go fat clothes shopping tomorrow as none of my holiday stuff fits.

    I guess I'm a bit afraid that by opening something they'll be peed off even more and drag their heels even more? Or worse - refuse to refund me?

    Not a secret no, more that I've not got my head round it yet as it wasn't what I thought it was ? . It's Pink. Although there is a 2% chance they got it wrong so I'm clinging onto that ?

    Hon im sorry, but they have left it long enough!

    Go straight like Mel said and open a case.

    And follow the steps to set it up tonight, basically paypal will get in contact with them and tell them their taking the p and spank them for your money they give them 30 days...

    I did this a while back, when i didnt get something from ebay, I never heard from the seller so had my cash back after the 30 days or so...

    Out of interest, did you return the product by recording delivery? If not try not to worry, they're prob just hoping you'll go away and forget it but really, you won;t Smiley winking

    As long as you are within the returns period then yes, you have a right to have your money back...

    Is it possible to see their website/ebay page?

    Do they state they do not return items?x

    Under Returns at the top of their page they say 'Returns Accepted'. Its only on their own website page (which I didn't go on until they started to dispute this with me) they say they don't accept returns. Everything I have read (and as a small website shop owner myself although not on ebay) and understand is that under the distance selling laws you HAVE to give the buyer chance to change their mind and must offer a full refund. Not including postage unless the item is faulty of course. The only time I don't do refunds is on made to order jewellery and items that are personally engraved.

    I hope you get all this ebay stuff sorted out, it doesn't matter what's on their own website, you bought through ebay so can do the dispute and paypal dispute to get your money back. If they drag their heels because their noses are out of joint, it just makes them look worse and it's better for you!

    I just had a funny feeling it was going to be pink, no idea why, just did! I know it's easy for me to say, but Im sure once she arrives it wont have mattered what the flavour was, you'll just be delighted.

    Fab about the honeymoon, Im really glad you've got something, that's brill. Flat clothes! Phah! You looked stunning in your pic and it's it's bambino anyway! x

    Well you cold be extra cheeky and say if you had of known it would be that quality you never of ordered it therefore not having to pay for p&p in the first place.

    No expert on ebay but just on the fact that they say they're a UK seller n clearly aren't must be a starting point. If the item is not 'as described' then you are perfectly entitled to send it back n ask for a refund (whether it be a business or private seller, i believe)

    You should be able to use your Royal Mail tracking number on the Spanish post website (www.correos.es) to find out if your parcel has been delivered. I haven't tried for Spain but this works for me with other countries. Good luck.

    I would open an 'item not as described' via ebay and then if they don't respond or resolve it ebay/paypal will have to and you usually get a full refund.

    As for the parcel going to Spain, Royal Mail do not track once it is out of this country, (as I have experienced), so you may find that they 'never' receive it.

    Thanks girls! I'm not used to sending things overseas, if I sent this parcel on the 2nd, would you have expected it to have arrived by now?? It's only to Spain, not the back of beyond!

    If you sent it airsure, then yes as that goes on the first available flight. Airmail not signed for up to 2 weeks.
