O/T tax credits

superlauren321, 22 May, 2011 at 19:16 Posted on Planning 0 6

Hi all hope you've had a lovely weekend

i dont really know whether im writing just to get it out of my system til i can actually speak to someone and sort it out, or whether im asking for advice to be honest. i know itsd all my own fault but not through a benefit fraud kinda situation!

just come to look at the tax credit renewal and when we've looked at our p60s between us we've earned a lot more than they think we have. this is a genuine mistake (i know thats not an excuse). im gonna give them a ring tomorrow to check what will actually happen to us, but does anyone have any experience with this? truth be told i am PETRIFIED that we'll be taken to court?!?!

thanks all

xxxxx

Hiya, ive not experinced it but i know people have. If you state its a genuine mistake, they will be grateful that you have been honest about it. But they make you pay back what you have had.

They will simply make you pay them back. This will be done either of two ways.. they will either take it from future awards, and if you aren't entitled to future awards they will simply ask that you pay it back to them either in full or you could set up a monthly debit.

Don't worry hun!!!! When my DF changed jobs a few years ago I rang them to tell them was assured that I wasn't to worry and if anything was to change regarding our tax credits they'd let us know. Nobody got in contact with us so we (naively) assumed that no changes were needed. Anyway, fast forward a year and we had been overpayed by a fair bit, They simply took a chunk out of our monthly tax credit payment throughout the next year,

It has been a genuine mistake so please don't worry - they won't take you to court hun! Smiley smile x

Recently, i had a similar situation as I am one of the 2 million people for whom HM Revenue and Customs made a mistake for the last two tax years in that when they updated their computer syustems they didn't record properly info from my employer so they did not tax me for my staff mortgage. Now they want nearly £2000 in owed tax and I have contested it but they won't give in as they would create a precedent and all those 2 million people could then challenge it. However, because it's quite a bit and we have no savings or spare income, they have accepted to take it through my tax code over the next 2 years which means paying extra £50 or so in tax each month through my tax code... But no court or the like, so don't worry!

Don't panic. There is an income disregard of £10,000 for tax credits from April 2011 (previously £25k) You just need to phone the tax credits office and let them know. It is more to do with your renewal than the previous year to ensure that it is correct going forward. Depending on the difference they will normaly collect from future payments.

The HMRC site has some useful info https://www.gov.uk/changes-affect-tax-credits
