Quick questions for anyone that knows about appeal hearings, please

Ice Queen, 13 August, 2008 at 10:57 Posted on Off Topic Posts 0 3

I have a friend who has an appeal meeting tomorrow, the company he works for are a shambles, but basically, he has a couple of questions :-

1) Can the person who held the initial disciplinary meeting take or be present in the appeal meeting? If so, do they just have to sit and listen, or can they comment?

2) Who is my friend allowed to take to the appeal with him? Is it a co worker or a union rep only?

Many thanks

The appeal has to be heard by someone different, normally it's someone higher up in the company but if this isnt possible then just a different individual. I think (but am not 100% sure) that the person who held the inital meeting can be there to comment if called upon to do so.

The employee can take a working colleague or trade union representative. Sometimes companies allow a friend or partner for moral support, but this purely depends on the company, they dont legally have to allow that.

Depends on the company. Under the statutory procedures as a minimum the appeal should be heard by someone more senior but there is nothing that says the original manager can't be present. The employee should be allowed to be accompanied it is usually a rep or colleague but sometimes companies allow others to be present.
