Redundancy concerns

After returning from maternity leave less than two weeks ago, I together with the other girls in the secretarial team, were told that a restructure would take place and that we were all invited to apply for any of the 6 available positions, however there are 8 candidates. We were told that we could opt for voluntary redundancy if we weren't interested in applying/ any unsuccessful candidates would be offered redundancy (same package).

Anyway, to cut a long story short.... it looks like 4 of us will actually be leaving. We all have concerns that the new structure will work and would rather accept the compromise agreement and start elsewhere.

Now, could our employers change their mind and scrap the restructure? It has received a lot of criticisms across the board. I have already notified my employers of my acceptance to take the voluntary redundancy and have started to register with agencies etc. I was told that we would probably be free to leave by mid to end of April, however no dates have yet been set for interviews etc as questions remain unanswered (such as revised salary scales etc).

I haven't received a compromise agreement yet and the HR manager is extremely elusive. I have interviews lined up and feel unsure what could happen now....

    Would you be happy to start a new job anyway?
    I think I would be tempted to keep job hunting, you can always turn a job down...

    Yes, I am excited about starting a new job now although it was a real shock at first. Trouble is, with the compromise agreement they were offering 2 months' wages tax free on top of the statutory minimum. Really don't want to miss out on this cash (!).

    Depending on your companies conditions of service, they may need to serve you notice of redundancy(which is often, although not always 3 months) Many companies then offer to buy this out to "get rid" of the staff more quickly. Make sure that you are not missing out on this possibility(no guarantees, it does depend on who you work for and your staff contract)

    Thanks Peter. They are offering us their 'standard' package of 2 months which constitutes one month's payment in lieu + an additional amount equivalent to our contractual notice period. I wasn't entirely happy with this at first but now worry that they may scrap the whole restructure leaving me with no money at all. I definitely want to leave....

    Am I misreading your post, or are 4 of you expecting to take VR and go elsewhere? Assuming that the staff available fit the roles available, then they aren't going to release 4 people to leave themselves with 4 staff for 6 positions, surely? Just because you apply for VR, it doesn't mean it will be granted.

    Apologies if I've got it wrong, and hope it works out well for you whichever way it goes.

    Well, that is what I'm concerned about.... I don't think our employers considered the possibility that we could decide against applying all together. Myself and two other colleagues have advised HR by the deadline that we are accepting their VR, however details have not been confirmed in writing.

    Meanwhile, two other colleagues are waiting for answers to their questions (such as salary scales/ overtime buy out etc) which appear to be dodged despite the fact that our decision deadline has passed. They are now considering to leave as well as the HR manager is very evasive and they naturally see no point in applying for a job of which they don't have the full details.

    The other three colleagues' jobs are pretty much safe and their interview will really be a mere formality...

    I guess anything could happen. It would be unprofessional if they did change their mind, but they are dependent on us staying if they need to get external staff in so we can train them accordingly... (they may not be able to start till May). God, what a mess. First they spring this on me the second day back from maternity leave, then let us worry about it all over Easter and now the suspense is ongoing. It isn't fair really that they aren't answering our questions. HR has come across very ill prepared. The partner group hasn#%92t thought it through properly at all.

    Be careful about saying you have another job lined up already as effectively you are resigning to go to a new job and they might not pay you the redundancy money.

    Obviously take legal advise on that, however I do remember that situation happening to someone going through redundancy at my old company. Because she found a job before the notice period was up she didn't get paid any redunancy money.

    I'm surprised you don't have anything in writing by now - sounds like they were surprised by 4 of you wanting to leave.

    If 4 of you have applied/do apply for VR you will not automatically get it because you requested it first or that all 4 of you will get it.

    You will probably (though not always the case) find in that situation that the people who are cheapest to make redundant get VR.

    Like Shooting star said becareful what you say at work about looking for work/accepting another position.

    But in answer to your original question could they scrap the idea - yes they could.

    Also, on top of the redundo, do not lose any leave entitlement that you are due. Possibly negotiate to take this in cash rather than leave earlier(unless you have a job to go to...
