Returning e-bay purchase, is there anything I can do?

I'm hoping I haven't shot myself in the foot over this one.

I bought a 2nd hand nintendo DS from e-bay about 10 days ago as a present for my mum for mothers day. It arrived boxed and with all instructions as described and really quickly so I left positive feedback. Yesterday I gave it to her with a brand new game, only when she tried to use it the screen wasn't calibrated, we've tried to calibrate it but it won't save the new settings (game works fine in another DS).

I e-mailed the seller requesting a refund and he has replied today telling me that I must have broken it. Now I know it's my word against his but I'm angry that he has £60 of my money and that my mums present was buggered.

Is there any point in trying to go through e-bay or Paypal or have I been done?

    I would contact a store like game and make sure that whatever you're doing is correct, then get them to state what the issue is. Then with that issue, got to ebay disputes...fingers cross, they'll believe you and you be entitled to a refund.

    Go through Paypal's resolution centre and open a dispute, you will need to say that you left feedback without checking that the item worked. The seller will respond and then Paypal will decide whether to refund you or not.

    Leaving feedback means nothing. Raise a Item Significantly Not as Described dispute with Paypal. Be prepared to have to return the item to the seller and when you do make sure you send it special delivery. Recorded isn't good enough it needs to be special delivery to prove it was returned and also because of the value of the item. recorded will only be covered up to £36 and if it was lost then that is the value you could claim from RM. Paypal then wouldn't refund as it wasn't returned.

    Generally Paypal side with the buyer and will refund you once the item is returned to the seller by trackable means (hence the special delivery)

    If I were you I'd take photos of the item and any messages on screen and serial number etc, just as records

    ETA: take it into a games shop just in case you're doing something simple wrong first. But do it sooner rather than later as you only have a limited time to rasie a dispute

    Thanks and sorry for taking a while to get back to you.

    I have had it looked at and the calibration is buggered to what seems beyond repair. I hope to get my money back and then think I'll bite the bullet and just buy her a brand new one instead.

    Get that in writing and follow the Significantly Not As Described route as outlined above. Call Paypal once the dispute is open and tell them you have written evidence from a reputable retailer and insist that they receive it from you via fax. They may say they don't want to see it but push them on the basis that the seller has already been difficult. PP could care less what the feedback situation is.
