I bought a new 'buy it now' shirt for OH which on receiving I felt wasn't very good quality and didn't look like the photograph (but I understand its sometimes hard to portray things accurately). The label said it was a 'salesman sample' (althought the seller had tried to scribble this out) so not sure if it was thinner material than a regular shirt but whatever it was very thin. I informed the seller (a business seller) I wished to return it and did so by first class recorded post on Tuesday and they got it Wednesday.
Yesterday I still hadn't received a refund so I emailed the seller who confirms they have it but are considering how much of a refund they will give me as it won't be a full one as they say that the packaging of the top isn't in tact. I'm not sure what they mean by this and haven't answered my subsequent email asking for clarification. We'd taken the shirt out of the packet to try on obviously then I put it back together as well I could but they have plastic in the coller/cuffs etc so its hard to put it back exactly. Also the plastic bag it came in I had to rip open to get it out so not sure if this is what they mean? The bag wasn't in great shakes anyway as it had a large square cut out of the front of it, where I can only imagine it again had some reference to the shirt being a salesman sample/price etc.
Can they withold part of my money for these reasons? When is acceptable for them to give me a refund? Its 8 or 9 days now and I want my money back.
