Suit hire company trying to charge me!

Little Pixie , 3 October, 2011 at 11:42 Posted on Planning 0 8

When my OH tried on his suit the night before the wedding the trousers were a bit too long. They got a bit muddy. My Dad took them back on the monday and the man in the shop said there was a tiny hole in the bottom where they had been walked on. He told my Dad they may have to charge us.

They sent a text while we were on honeymoon to say we had 14 days to pay £50 or they would pass it to debt collectors. I emailed them when we got back to thank them for the stress of the text while we were away and also to explain that they obviously had not measured the suit leg correctly hence to reason why it was walked on.

I have emailed them several times to try and discuss but they just keep sending threatening texts. I have today sent them details from the office of fair trading showing that they can not keep threatening us while there is s dispute ongoing.

Lets see what they say to that. There is no way I am paying though. They messed up and made the trousers too long. Not my problem!

As much as I think the suit hire shop is handling this badly they are probably in the right. (depending on how their 'terms and conditions' are worded).

Most hire terms and conditions will state that it is the hirers responsibility to check everything prior to wearing. If the trousers were checked and tried-on only to be found too long, it is then down to the hire shop to rectify their mistake prior to the wearing date. If they could not or simply refused then you have a good case. If you never told them of this error then there is very little argument I am afraid.

Playing devils advocate for a moment. Did you measure the trousers to see if the leg length was actually longer than it was on the order placed? Were the trousers actually too long or just being worn lower on the hips than were advised when tried on? Were there braces supplied with the trousers which were not worn?

Obviously any of those things could cause the trousers to be too long and wear a hole.

To be honest it is always very frustrating when trousers are returned with holes in the bottom, and I wished that sometimes I could be bothered to try and charge people for them but I don't bother and I very much doubt the hire shop will bother for too much longer either. £50.00 is not going to cover the expenses of a debt recovery agency or even proper legal representation.

So I would imagine that they will drop the matter once you have wrote a strongly worded letter, insisting that you are not going to pay the £50.00 as it was not your error.

Good luck and as others have said stick to your guns,

    Marc

Mark, My arguement is that the suits were not ready until the afternoon before the wedding and I was paying them to provide a suit that fitted. Hence the reason we went to them and got all the guys measured. They even checked the measurements again.

I am sticking to my guns. The least I expected from them was a suit that fitted as that is the service they are supposed to provide. If they had contacted me by phone or letter explaining it all properly then I might have paid but to get texts and then have them ignore my emails is just wrong. Not only is it wrong but companies are not suppoed to continue with a debt collection process while there is an ongoing dispute and they have by ignoring me and continuing to send stupid and quite threatening texts.

    The battle continues...............................?

I agree with you Dion. They should not be sending silly, threatening texts and should have sent a polite letter. Very childish behavior and not at all professional. ☹️

That is my next step now Annie. They have not been following procedure for debt collection so I think they need a warning at least

    Hi Dion,

Have you had any progress on this? Are they still texting you?
