TOGS advice please

I have just received a contract from the photographer we have shortlisted and the clause Display is causing me a few issues.

I get that photographers need to promote their business but I thought it would be up to the couple if their images were used as below. Is this standard or do you think I should query it with the photographer?

I wouldn't mind the odd shot being used but I don't like the onus being all on them.

I've copied it below. Please post advice.

It reads as follows; DISPLAY: The clients hereby allow the photographers to display any images covered by the contract and to generally promote the business by means of advertising, publicity material, websites, exhibitions, competitions, magazine articles, and other such media, providing the images are used lawfully.

    That is a standard condition in any photographers contract, if you are really worried about it then ask your photographer not to post/use the images, I get it about twice a year, some clients just don't want their photos displayed anywhere.

    Yep that's the same for me, it does happen where personal circumstances are that they do not want to be seen and like Bruce said just ask them " could you not " or ask if you could ok them first if you are worried.

    It's a standard thing and shouldn't be something to worry about ?

    Just have a chat with your photographer and let them know how you feel. Unless you're looking to book with someone who is portfolio building most TOGs should be more than happy to not use any of your photos in this way. Just make sure you let them know what you are/are not comfortable with if it's anything specific you're worried about.

    yes you have the right to request this.

    in the Copyright, Designs and Patents act 1988 it says:

    A person who for private and domestic purposes commissions the taking of a photograph or the making of a film has, where copyright subsists in the resulting work, the right not to have—

    (a)copies of the work issued to the public,
    (b)the work exhibited or shown in public, or
    (c)the work communicated to the public

    Just ask the photograper to amend that part of the contract and you're good to go

    That's all well and dandy me-lud. But weddings are neither private or domestic, they are treated as a public event as you can not stop anyone entering the church for example. Furthermore I would add and inform the learned lady that anyone attending a wedding is deemed to and has by their said attendance to the aforementioned public event waived any image rights they would normally have had, would this of been random photographs taken in the street in a non wedding environment. or somthing like that?

    Yet I have been asked plenty of times and its never a problem for me, due to being teachers, or ex's or other family issues, even had it a couple of times where the couple did not want me to show any of their venue as they said my photos made it look a lot better than it was and they were wanting to complain to the venue.

    I would just have a word with your photographer and i'm sure it'll be a case of using a few shots and not a whole heap. Smiley winking

    Not quite m'lud :-)

    Whilst the ceremony itself may well be a public event (if held in a public place). the rest of the wedding (i.e. the wedding reception, bridal prep, groom prep etc etc) is cerainly not a public event.
