Would you divulge neighbour problems when selling house...

Copper, 23 January, 2009 at 11:58 Posted on Off Topic Posts 0 7

....if it was something that happened 6 years ago? When H moved in he and his neighbours didn't hit it off. Lots of unreasonable (in my opinion) complaints about H re-decorating the house during the day when neighbour who worked permanent night shifts was sleeping. It all resulted in an almighty row whereby neighbour threatened assault against H and H called the police. Police visited neighbour, calmed situation down and an uneasy rest came about. This neighbour no longer works nights and we have had no further issues with them. We don't talk to them/like them etc but there are no problems as such.

We have been trying to sell our house for 8 months and this has been niggling me as to whether we need to say something (legally) to potential purchasers. I don't remember there being anything in the HIP paperwork about it but don't want to get caught out later down the line.

If it was you, would you say something? I guess I'm trying to convince myself that it was 6 years ago and it's all blown over.

Unless there is an ongoing dispute, then no, you dont need to divulge it.

I would, to be on the safe side. We've recently moved and had to explicitly answer the question (so would have had to have lied to say 'no' rather than saying nothing). We were very honest - "Two years ago we had very noisy neighbours in the student house opposite. After speaking to them a number of times, a group of neighbours (including us) wrote to their landlord and we have not had a problem since" (or something to that effect).

It didn't put our buyers off, and we are comfortable that we've not hidden anything.

I'd say nothing. The dispute is a long time ago and there's nothing still going on so new residents don't need to know imo.

    No, I would keep quiet.

Thanks all, it's not ongoing so I will take a chance on not divulging it! Fingers crossed because we finally accepted an offer yesterday.

I agree, and for those reasons. A one-off incident six years ago is radically different from wild parties every night and kids running rampant.

Again WSS. The people who used to own our house fell out with our neighbours, but we get on really well with them! It would have made us worry for no reason!
