Can your ex-employer take money out of your bank?

Consuela Banana Hammock, 23 April, 2008 at 12:44 Posted on Off Topic Posts 0 10

My ex-employer has now paid me for the past two months despite the fact that I haven't worked there since 7th March. When it happened last month I told them immediately but this month they've paid me again and I've decided that they can contact me to get the money back as I'm fed up chasing them when they're obviously being so inefficient.

H has suggested we transfer the sum from my bank account into a high interest instant access account in the meantime. Obviously as soon as they ask for it back, they can have it!

But I'm not sure whether they could take it back themselves from my bank account and therefore put me in the red? Is that possible or is the only way of them getting it would be by me writing them a cheque (as I did last month).

Does anyone know?

Do not transfer it. it isnt your money.

despite it being irritating, ring them, tell them, send them a cheque for the money.

As ever - good succinct advice Nick! ?

The regional office know and they rang the Salaries Dept at HO and told them to write to me/ring me directly but as yet I've heard nothing. [B)]

If you are working elsewhere and being paid by someone else you might need to check whether this has affected your PAYE contributions. If you have left then you should have been issued with a P45!

I'm not working. ? And no, I did't get a P45 because that would assume the Salaries Dept knew what they were doing. I've just got an incorrect P60 which obviously I will get altered once they contact me and we sort out this mess.

I'm going into my old office this afternoon so will ask my ex-boss to contact Salaries again and try and get me a contact name and number so I can sort this out. Useless the lot of em. [rolls eyes]

I remember a previous post like this one, with the OP saying they were planning on transferring the money out into a high interest account. And someone [more knowledgeable than me] said that the employers could in actual fact get the incorrect payment reversed?

In which case I'd certainly leave the money well alone, just in case.

Yes they can reverse the payments back out - BACS allows this process.

More likely if you ex employer banked with a UK clearing bank.

Thanks for the further advice. ?

I've emailed a friend in the office to ask if my ex-boss is in today so I can swing by her desk and chase this up. I do wish they'd stop paying me! ?

They obviously didn't take you off the payroll, because if they had you would have received a P45 and not a P60

You need to tell them ASAP as all the year end paperwork is likely to have already been submitted and it will be a real headache for them to sort out

they cannot do this unless they have the approval of CSB.
