Magistrates have an upper limit on the sentence they can give. If they think he needs a bigger sentence he will be Commited for sentencing at Crown Court.

Is it crown/magistrates he is going to?

I should think he will get sentenced tomorrow then. Maybe they just like their list to reflect whether the case has been forwarded by a magistrate or not.

Commital for sentence should mean that a date for sentencing will be decided tomorrow, not that he will be sentenced tomorrow. However, don't rely on court lists - they're not always 100 per cent accurate and a judge may decide to sentence anyway tomorrow.

The court system does need an overhaul - I've recently been following a case where someone is being prosecuted for careless driving and there have been eight appearances so far. Heartbreaking for the family who's son died as a result of the careless driving.

This will be the 5th appearence in court, and 10 months to the day he was arrested, since then we have gone through, child protection register, social worker interviews, homeless application,CID statementing, 2 not guilty pleas, 1 guilty plea, and a pre sentance report, I just hope tomorrow is the end of it and we can all get on with our lives.

It's horrendous isn't it? The process is greatly shortened if someone pleads guilty but otherwise you're just at the mercy of the system. It might be worth a letter post-sentence to the courts about how traumatic and dragged-out the process has been for you. The only way to change the system is if enough people make a song and dance about it. Hope it goes the way you want it to. x
