Compensation Amounts

Koshka, 9 April, 2008 at 18:19 Posted on Off Topic Posts 0 4

Over the next few months I am going to be recieving two compensation payouts for personal injurys I have suffered.

How can I be sure that the solicitor/s I am using are getting me the best/largest/correct <not sure which word to use> amount of compensation?

Am not wanting to be Little Miss Greedy but I do want to make sure that I am getting the right amount of compensation for the injuries/stress I have suffered.

Is there some secret scales that solicitors go off or do they just randomly guess at an amount?

I've never been through anything like this so have no idea what the correct procedure is.

TIA ?

Your Solicitor will quantify your claim by studying the latest JSB guidelines and caselaw prior to entering into negotiations with the other side.
I can assure you that a Solicitor has what is known as a duty of care to you as his/her client and will not 'rip you off'.

I'd love to know how they work it out. In 2000 I went into the back of a guy in slow moving traffic, literally doing 2mph when I hit him. There was non damage to his car, not even a scratch in the paintwork, but he claimed whiplash and got £8000.

Fast forward to 2005 and I was hit by a lorry doing in excess of 30mph. Over £1200 worth of damage to my car. I claimed for whiplash and got £3900. Don't know how they can say that's fair.

Surely it depends on the severity of your symptoms?

As Gemblebee said, your solicitors will use the JSB guidleines and case law to assess the value of your claim.

Melancholie, the driver who you crashed into may have claimed loss of earnings and other expenses as part of that £8,000.00. It is often these items which 'bump' a claim up.

Loss of earnings has a lot to do with it. Almost 5 years to the day, I was in a serious crash and had a neck fracture and other injuries. I was a passenger so it was no fault of my own. I got a few thousand but nothing like these silly advers where "I slipped and hurt my knee and got £10,000"
I was on full pay through my sickness (5 months) so I had no loss of earnings. If I had lost out, however, I would probably have got double.
