HR & Employment law - holiday entitlement question

Hi all,

Just wondering if I can pick your brains- it might just be a short NO so just tell me to bugger off if that's the case ?

Basically situation is:

H started his new job mid-November, full-time permanent job. Was told that he'd have 2 days holiday accruement by the end of the year. In January he was told that for 2009 he would have 25 days - 7 as he'd taken days off between Xmas and New Year (he didn't have much choice as company was closed between those dates) and the first 2 days in January.

My question is - can he apply for unpaid leave? Should an employer be able to allow him that, as a general rule of thumb? Reason being that <selfish tangent> I'd quite like a holiday this year </selfish tangent> and I've still got about 15 days left, but H doesn't want me going on holiday without him (understandable). I know where I work that I couldn't get unpaid/compassionate leave around a family bereavement last year, but I know that my employers are a bit hazy with their employment law..

    He can ask but they don't have to give it to him.
