Not received video 8 months after wedding

HappyRedFlowers876, 23 March, 2022 at 20:11 Posted on Just Married 0 3
Hi everyone,

I got married (after 3 postponements) in July 2021. We hired a videographer to shoot just the ceremony in detail. In total about 1 hour and told I would receive a film with highlights and readings/vows etc.
About 2 months after, I contacted them and they said they were very busy due to backlogs and it wouldn’t be long. The same in the October, then in November, then in December. Then in January I was told it would be done by a certain date for definite. That’s been and gone by a month and I’ve emailed again and been told there are ‘no updates’ on when it will be ready, just ‘it won’t be long now’. No reference to the previous promised date.
I’m really worried about this. They respond very quickly to emails and are posting and doing work all the time on social media. I checked and they have completed and posted work for couples married in November 2021.
My main issue is that I can’t find my contract anywhere, and suspect it was deleted in the months following the wedding (huge mistake I know). I’m gutted. I do have the payments coming out of my bank statement and emails but that’s it.
What can I do? I don’t want to pursue aggressively as I worry they just won’t provide the video or it will be rubbish.

It sounds to me that it is possible they have lost the footage, not what you want to hear, but I can't see any other reason why they are stalling.

I would message them with a timeline of all your contacts and ther responses/promises and also reference the fact they have posted weddings after yours and tell them it is therefore not unreasonable now for them to either send it within 7 days or you will have no option but to pursue them through ADR (Alternative Dispute Resolution) process, which if fails would mean a small claims case for breach of contract and claim to recover your cosyt as they have taken parent and not delivered the service., Which would result in a default and CCJ to be issued.
It will be tricky without the contract, but you do have evidence in your emails that they have not delivered. Have you checked your sent items if you sent your contract by email it should be in there.
I work in contract law so happy to help you with wording I'd you want to send me a private message with the timeline x

    Oh my gosh…

First, try not to worry about the contract. They don’t know you’ve lost it, and even so, your emails, payment and their involvement on the day all constitute an agreement, even if not in black and white.
I would definitely contact them now and, as said above, give a complete breakdown of all points of contact and ‘reasons’ they’ve given for the delay. Tell them you want your video in the next 4 weeks or you’ll be taking legal action.
My sense is they’re delaying because they’ve got away with it for so long that they’re prioritising other things, so I would show some force and give them an ultimatum. Xx
