Photographer Blocked Me and Withheld Video

LuxuriousBrownDiamonds69528, 7 December, 2021 at 06:54 Posted on Etiquette and Advice 0 3
My wedding photographer has blocked my number and isn't responding to my emails. Here's what happened:
We got married in Summer despite some restrictions. I paid for a package including videography and still photography with an engagement shoot. I paid in full prior to the event.
We received photos and a preview video hosted on Youtube a couple of months later (summer being a very busy period for photographers). He then invited my wife to meet him to discuss albums in November. I was not keen on purchasing an album as the prices were quite high on top of the £2000+ I already paid but she said she might buy one as a gift to family so arranged to meet. First meeting was cancelled as he had to self isolate. By this point it was late November and we had decided to try to go on holiday over Christmas (Omicron allowing!). So much time had past that the allure of getting an album had somewhat worn off for my wife. Finances also had to be allocated elsewhere (energy supplier collapsed and bill increased+++). So my wife cancelled the meeting stating that she had changed her mind. He then proceeds to block our numbers and doesn't respond to emails.

The trouble is we do not have the video ... just access to a preview hosted on Youtube.
I can see why he is annoyed at my wife for letting him down but as the contract for photography and videography was with me, and paid for by me, I don't see why I cannot get the video that I have paid for.

I am sorry to hear of this, as this was an addition and he should not have expected an up sale, and then to behave this way is not acceptable. If you have not received what you have paid for I would suggest you send a recorded letter to his address (should be on your contract) outlining the dates and means of attempted contact, and then state what he has not provided as part of the contract (quote it as it is written in the contract) and that as he has blocked you this is your last option. Advise he has 14 days (give the actual date) to provide the missing contractual goods and if not then you will seek legal advice through ADR (alternative dispute resolution) as he is in breach of contract, if not you will go to small claims court. Hopefully that will be enough to get him to respond. Keep it factual and no emotion, do not mention the album or meetings as it is not relevant to the outcome you are trying to achieve. If you need any help feel free to reach out, I work in contract law so happy to help if I can

Thanks for your reply. Hoping not to go down the legal route as everything will be sorted if he can just send me the video. Service was otherwise good.

It is a shame when things break down, as you say the service was good on the day, you just want what you paid for. Maybe say in your letter how happy you are with the photos and the service provided and you are looking forward to receiving the full video you paid for. Make it more complimentary than demanding, but I would give them a date to come back to you by or it will just run on and on. You could ask if there is a problem with the footage or is it lost, and is that why it is delayed? It may not be the issue, but if this is the case then you deserve to know, as hard as it would be to not have it, at least you will know and can work on some sort of refund for the missing element if he cannot now provide the full video. Good Luck
