Refund from a shop without the card it was purchased on

My husband bought me a dress but - lovely as it is - I'm not going to wear it and it needs to go back to the shop. I've got the receipt but the shop seem to be saying that unless he, and the credit card it was purchased on are present then they can't process a refund.

Is this legally correct or can I insist on a refund either to my own card or to his card even he's not there? A store credit won't work as it's not a shop that I would ever usually buy from and can't easily get to. Can anyone point me in the right direction of some info about this? I'm drowning in a sea of google results and can't seem to find anything relevant

    OH bought me some shoes from next on his debit card, i returned them with his card without him being present and there were no problems.

    I think it really depends on the shop's own policy. Legally, they don't have to refund you or exchange or offer a credit note at all unless the item is faulty.

    It was our policy in shop I worked in. If the card holder wasn't present with the card we offered a credit note

    I had this with Homebase, even though all I wanted to do was exchange an item. I had to send H into the store to exchange a small tin of paint - £5.98 worth. Jobsworths! Fortunately, they have since changed their policy.

    I'd just take his card into the shop, and get it refunded back on to his card.

    I think they have to refund back onto the card it was purchased on, to keep in line with the UK money laundering laws. It is probably policy as well.

    I am pretty sure that we are only allowed to refund onto the same card as was used to purchase - not our rules, that of the card providers. However, the customer wouldn't have to be present for us to process tha transaction, as we do 'customer not present' transactions. I guess in a shop it is different and they need the actual card

    Admittedly it was a few years ago, but the shops I have worked in they could only go back onto the card they were bought on for security reasons. One of them being that if you had dropped a reciept someone could pick it up, shop lift the item then try and get a refund for it (and this did happen on at least two occasions!). They need the card to do the refund though as the card number should be ***'ed out (bar the last 4 digits which is how they know its the same card!)

    My MIL bought a pair of school trousers for my son, and they were the wrong size - M&S will not refund onto any other card, or without the cardholder present either.

    Legally their contract is with the purchaser - not a second party and they do not have to deal with you at all.

    Legally they do not have to refund anything that is fit for purpose.

    Most places will do you an exchange.

    Well I did wear it out for a bit, but I've hung it on the line to get rid of the perfume smell. Did rain a bit on it but y'know, these big stores it's no loss to them is it ?

    Cheers for all your advice, I had presumed that it wouldn't be a problem to get a refund onto my card - wishful thinking! I shall try going in with Mr 'Dango's card and see if they'll at least do the refund onto that without him there - otherwise he's going to need to take an afternoon from work as we've no weekends that we can get there within the 28 days and the store is about an hour away. Damm him and his generosity ?

    i was thinking this only with a simpler method...someone could just nick your carrier bag off the bus or from a cafe or something. nine times out of ten the receipt will be in the bag. easy money.

    and this way you don't have to risk being caught for shoplifting ?
