Responsibility for musicians equipment

We have contacted a band to play at our reception but they have a clause in their contract that states that we will take responsibility for their safety and their equipment on the night. Should their equipment be damaged in any way, we will be responsible up to £20,000.

I have queried this and explained that we will be rather busy on the night and therefore won’t be able to take responsibility for their safety or any damage cause. They have come back and said if we can’t then they can’t play for us.

Has anyone else had this?

    I don’t think this means you have to have personal responsibility for it, but that you need to have insurance to cover it.

    Some bands, DJs and other performers will have a similar clauses in their terms and conditions - indeed your venue may have similar terms in their small print. It is an attempt to protect their equipment/themselves from damage caused by your possibly drunk /drugged up guests! When a performer turns up at a venue to perform they have no idea who you are inviting and how your guests will conduct themselves on the night.

    Many/most events will pass without incident, however fights and scuffles do break out and performers and equipment can get hurt or damaged - similarly tables can get broken and toilets can get smashed up by the odd guest that gets too 'refreshed and relaxed'.

    It happens - rarely - but it does happen at emotional events. It is something that you should be aware of and have a plan in place to help prevent anything happening and damage being caused.

    You know your guests and how they should behave - you might not know Pot Head Pete who is coming as a plus 1 with Tracey from accounts but he is usually OK - maybe task a couple of guests to stay sober and look out for any potential incidents - or hire in a 'door man' to take on this role.

    The performers will most probably try to protect their equipment if needed, so if they are bringing £20k of equipment along it is highly unlikely that is will all get damaged, however a speaker being toppled over and being smashed by a drunk guest could easily cost £1k to replace.

    So long as your guests behave themselves responsibly you should be fine and take on the 'responsibility' without too much worry.
