returning faulty goods- my rights?

oldspeckledtam, 12 May, 2009 at 16:17 Posted on Off Topic Posts 0 3

I have a Cath Kidston baby change bag that my mom bought me. It was purchased in December, I had my son in March and have been using it since he was born. Where there is stitching the colours have run where it has got wet.

I rang Cath Kidston and the lady confirmed there had been a problem with one batch of this bag. They are happy to exchange it, but only if I can provide proof of purchase.

I'm fairly sure my mother won't have kept the receipt.

I don't want a refund as I love the bag. I just want one that isn't faulty! Do I have any rights over this?

?

I have no idea why you'd need proof of purchase, when you've contacted the actual company. it's not like you're trying to get a refund from a store or something, and they could claim it wasn't bought there

quote the sales of goods act at her. s14 subsection 2 i think ?

Thanks KTC. I thought that if it was faulty proof of purchase shouldn't matter.

She said that some stores buy their products wholesale and sell them on (eg John Lewis) so I need proof of purchase.

I know where the bag was purchased (selfridges in Birmingham) and it's a concession, which she confirmed was one of their official outlets. It was a present and I'm gutted that it looks manky already.

I would have thought it wouldnt have made a difference as you are claiming directly from the supplier and are asking for a replacement

But as an aside - do you have bank statement or cc statement to show when it was bought

My pink lining bag was faulty - bought in august and the zip broke by march but i bought it online from them and attached my e receipt to prove when it was bought and then sent me out the replacement no probs

    good luck x

I imagine they'd want to see proof of purchase to show that you didn't steal it, not that I'm suggesting for a minute that you have!!!
