Setting up a club - legal requirements

Annabel, 2 April, 2009 at 13:56 Posted on Off Topic Posts 0 3

Have tried Google and today it is not my friend!

Could anyone who has either set up a club from scratch or is involved in a club point in me in the right direction.

BackGround;

About 6 months ago, someone in our village started up a classic car club - this just involved meeting up on the last Monday of every month for a few drinks and a gossip! However, there is now talk of paying an annual membership fee, attending local shows and raising money for charity and having trips out in the cars.

At the moment there is no bank account, no proper committee although there is a 'chairman' and a couple of people who share the responsibility for taking 'minutes' and circulating them every month.

I am concerned that if we are charging a membership fee and raising charitable money then we will need a bank account and if we are raising money for charity we may need a license to do so, so I am trying to find out what the legal requirments are eg. do we need to have a set of annual accounts, public liability insurance etc

I have searched the t'interweb but I either get existing clubs, how to start school clubs or how to set up a charity, none of which is helping!

Any ideas would be gratefully received.

Thanks

    This link may help - http://www.businesslink.gov.uk/bdotg/action/detail?type=RESOURCES&itemId=1077475675 - it is all about unincorporated associations, which sounds like the set-up you are describing.

    Lalu, thanks for that, that does look like the kind of organisation we are but there is still very little information about requirements other than we don't need to file annaul accounts.

    Thanks

    That's because there aren't any other requirements really, you basically make up your own rules and regulations.

    As that page says, the organisation is not a legal person so cannot hold property in its own name, so a bank account would have to be registered in one of the member's names, unless you set up a trust (which that page has a link on). If the organisation has charitable objects it may also need to register with the Charity Commission (again there seems to be a link).

    Here's another link I found through googling "unincorporated association" - http://www.maceandjones.co.uk/news/archive/unincorporated-associations.html - I am sure you can find more by googling that term too. Good luck.
