Supplier cancellation fee for covid

Christina, 11 December, 2021 at 14:54 Posted on Etiquette and Advice 0 2

My hair & make-up person charged a cancellation fee after the wedding was cancelled due to Covid, which I recently found out wasn't lawful. For the new date, they then announced that they'd have to leave 2 hours before the ceremony, so I went with someone else, and they kept my deposit. I'm down about £400 as a result.

I've emailed law firms but because of the amount involved, it wasn't worth them taking it on. Trading standards could only give advice but can't pursue things on your behalf, same with Citizens Advice.

I wonder if anyone ahs any advice for how I can get my money back?

It all depends on what you were contractually obliged to in terms of your commitment to cancellation. That said, if they supplier has changed the terms of the agreement and this has then meant they are not full filling the agreed terms of service the contract is frustrated and they are in breach. You can go to small claims court, is a filing fee dependant on the value of the claim, but again depends on the terms in your contract. I work in contract law and would be happy to take a look over your contract and give you some advice if you want to PM me

Thanks so much! When I looked online it said that, even if it was in the contract, it would be an unfair term or that covid itself was a "frustrating" event. I'll send you a PM though as you definitely know more than me about this!
