Tesco refusing exchange without tags - can they do this?

My H bought his father a jacket for christmas which is a bit small. He tried to take it back but Tesco will not take it back without the tags not even to exchange. We have looked everywhere but cannot find the tags, we had to take them off as they had the price on them in large text. He does have the receipt and the jacket is unworn

He is now stuck with a jacket that fits no-one and has to buy another one.

Is this usual, can they do this?

    I know Debenhams do this too, if the item has no tags then it's considered to be worn. I'm not sure the legal standpoint on it. I would try another branch of Tesco and see if you have more success.

    Under the sale of goods act you only have a right of exchange or refund if the goods are faulty or not fit for purpose. it doesnt include if you ve bought the wrong size, so to change it or refund is at their discretion, and evidently, theyre saying no. tesco website clearly says for a refund or exchange you MUST supply the tags.

    i d just try another store tbh, and see how it goes.

    Yes, of course they can. There's no way of them knowing whether the jacket's been wron or not if you've taken the tags out. Plus it's harder for them to seel it again without them. Some shops will exchange as a goodwill gesture but you can't get narky when they refuse.

    Fairly standard as far as I'm aware, most shops won't accept an item for a refund without the tags.

    They did do this to my friend but were also very rude to her and said she had worn the item and was just 'trying it on' to get her money back.

    She emailed to complain about the service (just the rudeness of the staff member0 and she did get a nice email back saying under these circs they would refund but is not normally done.

    It was trousers in her case and you could see they had never been worn.
