Travelling in maiden name - illegal?

pricicles, 13 June, 2008 at 12:56 Posted on Off Topic Posts 0 13

I got married just under two years ago, but havent updated my passport to show my married name. Since then, I have always travelled under my maiden name, ensuring that all travel is booked in the same name, and I havent had any problems at all. The reason I didnt update it was because at the time I got married, it still had 5 years left on it, and I had been told by several people that as long as travel documents match the name in the passport, then its ok to continue using it, and as I have had no problems, I had planned to continue doing so.

I've got two trips abroad coming up this summer, again both are booked in my maiden name. I just happened to mention this in conversation to a friend, and she was really shocked and said it was illegal, and I could get into a lot of trouble. Is this the case? Does anyone else still use their old name when travelling abroad?

Of course it's not - what about all the women who don't take their husbands' names - are they breaking the law too?

I've not heard of it being illegal. Many women have different names at work to their official documents, for example. I'm still travelling on my old passport after a year because I haven't got round to changing it yet. I do sometimes take my marriage certificate with me if I think there might be some confusion.

Why would it be illegal? My passport's in my maiden name and I've never got arrested for using it.

I think your friend may be wrong.

I am exactly the same (married 5 years now) and H and his family all get very huffy about it and say it's illegal. Which is bollocks, it's not law that you take on your husband's name. So now I keep it because I am stubborn ?

I dont use my married name, professionally it made sense to keep using my maiden name and as I have to produce my passport every time I go to a new contract I have carried on using that as Miss H and not Mrs M

Thanks - as I thought and I'll carry on as normal. Several people have been surprised when I've said I still travel in my maiden, but she's the first to have said this. She's definately not pulling my plonker ? just certain that she's right.

    Minor worry over then.

Hiya PHB - I'm good thanks.... not been on much - I've moved into a different office at work, and my new desk is in a really crap place.

Of course it's not illegal, what a ridiculous thing for your friend to say. Does she think that jails are full of women who didn't change their passports in advance of the wedding and went on their honeymoons under their maiden names?

My husband thinks this, possibly because you have to change your address on your driving license by law ?

She could be confused by the fact that you need to book in the correct name and just not realise that you simply book in your maiden name.

My passport ran out a month before the honeymoon so I had to renew it with my maiden name, and it shall be so until 2012! ? not illegal at all.
