Wedding Insurance - Public Liability

ExpensiveOrangeCakes62, 4 of November of 2013 at 15:56 Posted on Planning 0 11

My first post, so be gentle! We've set the date for our wedding in May2014 and I'm about to sign a contract with a local hotel to provide all the facilities (wedding room, breakfast, evening party etc).

The small print in the contract says "The Client will be liable for loss or damage to the Hotesl property including xxx, or injury to any person including hotel staff, whether caused by the client or any person attending the function, and shall indemnify the hotel against any loss or liability (other than the Hotels liability in (i) above [which refers to their negligence etc]) " The contract then suggest the Client take out insurance to cover this.

Now, I'm not legal boffin, but this effectively means I'm liable for ANY damage/loss caused by my guests. Whilst my friends/family are far from risky and the chances of anything major happening are remote and unlikely, I'm not prepared to chance it without some sort of cover.

The Insurance Policies I've looked at have Public Liability cover in them, but they seem to suggest that the cover is for any actions related to the bride and groom and not for the actions of others (including guests). If this is the case, these policies are not giving me the cover I need for peace of mind.

Can anyone help me with this as I need a policy which gives me 'comprehensive' cover. Ironically, the wedding we are planning is not expensive as the hotel costs are very reasonable, so I don't need the top end cover, in most cases the basic cover would suffice - as long as the Public Liability bit covers the actions of guests.

Guidance, anyone?

Chris

Ooooerrrr! I've read a lot of small print from hotels and where they mention PLI, it usually refers to third party suppliers that you employ for the day like togs, DJs and bands. I've not come across this before. Sorry....thats not a lot of help!

I would highly doubt that the hotel conditions would enforce that all members of the party have Pl insurance - these things usually relate to suppliers i.e photographers and they would (should) all have their own PL cover in place. The hotel insurance would also have PL cover in place (albeit potentially on a contingent basis only).

Do you have a copy of this part: (other than the Hotels liability in (i) above [which refers to their negligence etc]) to read?

Hi, I've been doing more research and found that Dreamsaver do an insurance package which suits this purpose. Their Silver package is only £25 (which has the right level of cover for me) then for an additional £19, they'll cover all the guests for PL up to £2m.

Their policy states: Section 11 - personal liability is extended to cover all persons invited to the wedding or reception by you in respect of legal liability arising from accidental injury to third parties or accidental loss of or damage to third party property.

This is exactly what I was looking for. And only £44 all-in.

Thanks for replying, all, I'll go for the Dreamsave option

I think it's a bit weird that your venue are asking you to have PLI. I always thought it was for suppliers such as the DJ, etc, not the couple.

@SquidgyBob - they weren't asking for all the guests to have PLI as such. The contract is worded such that I myself are responsible for the action of guests and thus any damage/loss is attributed to me. I guess the hotel want a scapegoat to go to in case there are problems. I'm not prepared to do that without cover. Luckily, DreamSaver Wedding Insurance cover PLI for all the guests at less than £20 extra so its a price worth paying.

@HundredMonkeys - I haven't booked an event of this type with a hotel before so I assumed it was standard T&C's? Alot of the insurance policies state that only the B&G are covered for PLI, so its worth others checking what their venue contract says and wether their Insurance policy gives adequate cover. As noted above, there are policies which DO have the relevant cover - you just need to check.

Could I please take this unashamed opportunity to to bang on about the need to make sure your photographer is professional and has public liability insurance - otherwise in this scenario at least you could be responsible for their actions and any damage caused by them. And read the small print in your own insurance if you think any suppliers brought in by you are covered under it.

This covers you for accidental loss - it would not cover you for deliberate damage caused by your drunken guests, that the venue would be chasing you for

    @Peter

Thanks for supplying a list of Insurance providers. Useful, but bear in mind it misses the point of this thread which was about PLI for guests. Just check out the policies in your list and you will find this ISN'T covered in many of them. For example, in the PL section of the John Lewis policy you'll find this exclusion...

This Section does not provide cover in respect

of liabilities arising from the actions of anyone other than the bride and groom or prospective civil partners, except insofar as the bride and groom or prospective civil partners would be held liable for them at law, and does not include any additional liability accepted under a hiring or booking contract

In other words, even if your booking contract with the hotel states that you are liable for the actions of your guests, this John Lewis policy explicitly excludes cover for guests. A very similar exclusion exists in the E&L Policy. Others, like Dreamsave and CoverMyWedding dont cover guests as standard but have a optional extension to the PL to cover guests.

So, be careful which policy you select. It doesn't really need stating, but read the small print to make sure your cover is appropriate for the contracts you are signing. They are not all the same!

Do you work for Dreamsaver? If not, you should ask them for a job doing their advertising... ;-)

Make sure you book a band with full PAT tested equipment and public liability insurance. My band has that and it covers things like guests falling into equipment when they get a bit merry and the like Smiley smile
