Bus Driver Advice

I regularly get a bus in the early morning (6am) and I have a serious problem with the driver. It's a service run by a relatively small local company and the bus driver is the same one every weekday. On the 6am run I am the only passenger. The bus driver chain smokes the 30 minute journey to my destination through his drivers-side window. I can clearly see him doing it in his rear-view mirror and also when I pay my fare he has 3-5 rollups waiting in the coin dish. I have serious asthma and I'm pretty sure it's illegal for a bus driver to smoke whilst on duty. He is extremely careless with his driving, swerving and veering across the country roads at quite a speed because he's too busy smoking and it really scares me. I reported him to the bus company on the one occasion where I wasn't the only passenger, they didn't sound too interested but played the authorative role quite well, promising that it would be sorted and he would be pulled up on it. That was over 3 months ago and he has been doing it ever since, as though they never even told him off. As I am the only passenger usually, I do feel very scared to report him again as it would be very obvious that the complaint came from me and I feel uncomfortable travelling alone as it is without some narked bus driver. I really do not know what to do, I don't like being around people who smoke, it aggravates my asthma and with the weather turning cold my asthma flare-up is at it's peak right now. What on earth can I do, there's no other bus service I can use, I rely on this one service.

    I would report him to Environmental Health.

    It is illegal for any employee to smoke in a Comapny owned vehicle, bus, car, van, lorry or otherwise.... this I do know as I used to be an Operations Manager in charge of a Company Fleet and had to discipline someone as a result. Since changing jobs I have a Company Car and had a whole load of bumpf was sent to me regarding this.

    Also contact the bus Company. No one should have to passive smoke!!!!

    I really see where you are coming for and although he is breaking the law, he would obviously know it was you. Maybe you could ask the environmental health if they could put someone on the bus. Longshot but they may do it.

    WMrsHtoBeS. Since the smoking ban I'm pretty sure what he's doing is illegal and by allowing him to do so the bus company is also acting illegally (in the same way that a landlord who allows people to smoke in his pub is breaking the law). I can't imagine the police will be very forthcoming with help as they will have bigger fish to fry but I agree that you should look to try to get some agency or other to put someone on the bus to catch him. Do you have community police/wardens, like the police that aren't really proper police IYSWIM in your area? Maybe one of them could help. Either that or speak to the council - I think local authorities have to give the green light to any company running a route so presumably they have the power to admonish rubbish bus companies.

    Oh i agree with everyone else. Tis illegal.......... get it sorted.

    Hubby made a complaint to the police about a van driver the other week, van belonged to a company, police got in touch to say van mans boss was informed and van man was going to get a talking to........ you cant p!ss about with legal stuff when companies are involved. Big fines.

    I decided to call the council and got a very abrupt and rude man who said that they do not employ bus drivers and that I would have to go through the bus company. How exactly can I make a complaint against the bus driver when I'm the only passenger on the bus at the time!!!!!! I know this sounds totally irrational but I am scared that if I complain again he could refuse me in future or confront me. I'm currently trying a company called bus users UK but I am very surprised that the council wouldn't help, I thought they subsidised bus services and had the decider over whether they ran or not. I would have thought this would have been something they would have taken interest in...

    I'm also very unsure as to whether I should get the police involved, it seems ever so severe. I wish I wasn't such a worrier...

    Boo to the rude council man. Perhaps you could contact the HSE for guidance on what to do? Failing any help from that direction I know you say calling the police seems severe but it does seem to be the only avenue open to you. Perhaps you could call into your local station and speak to the desk sergeant (I have no idea if this is the proper term, I watch far too much of the Bill/Taggart), explaining that you hadn't really wanted to involve the police but that the Council won't help you and you don't know where else to go with it. Understand that you'll probably be called an interfering busybody behind your back but if it sorts the problem who cares. This isn't an employment issue it's a legal/enforcement issue.

    You must complain again, with major bus companies this is a sackable offence, so similar will also apply with smaller bus companies, at least a formal warning. Can you visit the Bus depo and speak to the manager? Explaining your worries about being on your own on the bus. Is there CCTV on the bus? Could you take a photo on your phone?

    I totally understand your anxiety about reporting him, but the bus company are breaking the law here, even with the window open it will smell of smoke in the drivers cabin, another bus driver who drives the bus on another service will be able to smell it, so the complaint could come from them or even the bus cleaner. xx
