Wedding dress deposit can i get a refund?

I tried a dress on last night and fell in love, however the dress was 3 sizes to small and I was pinned in and it didn’t fasten at the back. The sales lady told me that my large chest wouldn’t be an issue as the seamstress would put support in the correct size dress and all would be fine. I paid £800 deposit. When I got home my maid of honor sent me the pictures and I suddenly realised it was a a completely backless dress even in the right size, I knew that there was no way the seamstress could add the support that I needed. I called the seamstress this morning and sent over the pictures she confirmed that there was no way I would get the right support and she would never of even showed a bride with a big cheat this dress.


I called the shop as soon as they opened and stopped them ordering the dress from the designer and a different lady said she agreed it would not be suitable for me. They are now saying I can transfer the £800 to another dress and when I asked what happens if I can’t find one, there not willing to discuss that. Where do I stand as I signed a contract to say non refundable deposit but I know they haven’t ordered the dress and I feel it would not be for for purpose, am I covered by the consumer rights act?

    From a legal standpoint you unfortunately have nonleg and onstane on as you signed a non refundable deposit. Morally they could refund as they hadn't placed the order so have not lost. I would argue that you did this based on asvice from them it could be altered, which they have now said was incorrect advice so they have frustrated the contract, bit it really will be up to them. In this case I would try and negotiate with them and keep calm and friendly as they are more likely to back down. The fact is they haven't done anything to warrent keeping the money so maybe try and see if you can get it all or say 80% of it back. Wish you luck

    I agree with Charlotte - legally, you have no right to the money, but morally, you do, since you only paid the deposit based on false information given to you by their sales staff.

    Most shops don't want to end up with disappointed customers, and since they admit this cancellation won't cost them any money, I think it would be worth persisting. Be polite but firm, and point out that the only reason you have paid them the £800 is because of wrong information they admit that they gave you.

    Hopefully, they will realise that having an upset bride (who is probably going to warn everyone she meets not to use their boutique) is not worth hanging onto the money for. If they prove obdurate, you could try for a compromise - if they sell accessories, then you could maybe agree that if you buy those from them, you get the rest of the money back in cash?

    Thank you both, I am going to discuss it with them on Monday and see what they suggest. I really hope we can come to an agreement.

    Hi em i mentioned this to my SIL she is a solicitor by right you should not get your money back because you signed but from what you said you were given false information but the problem she said would be proving this as your case because they could say they never said this so you have to prove it all sorry i havent helped much xx💗
